• Black Forest Industries is not liable for any damage or loss caused by the installation of any parts or accessories purchased. The buyer understands the risks involved in vehicle modification and takes full responsibility at the time of purchase and will not hold Black Forest Industries responsible in any way. Some items are for off-road use only, please call to inquire about the legality of some products in your area. Pricing and availability subject to change without notice.

• All orders over a predetermined dollar amount that have a different shipping and billing address will be contacted to verify your order. If you are unable to be reached, your order will be automatically cancelled. To avoid any delay, we advise having your purchased shipped to the same address as your billing address.

• Black Forest Industries has a zero tolerance policy for credit card fraud. Please beware that we will seek out and prosecute any individuals attempting to use stolen information. We have dedicated staff which communicate with authorities as well as investigate and expose fraudulent customers.

• Some products on our website have an advertised availability lead time shown above the green 'Add to Cart' button in their product listing. This lead time means these parts do not ship until that time period has been satisfied. In some instances, the lead time may be longer than what is advertised due to unforeseen delays and/or additional lead times from our suppliers. We always do our best to ship your product as soon as possible, but uncharacteristic delays sometimes occur. If time is of essence, please contact us prior to making your purchase.

• All multi-piece wheel lips and barrels are manufactured on a per-order basis. These are special order items which take anywhere from six to twelve weeks to manufacture. Placing a pre-order for multi-piece wheel lips or barrels guarantee they will be produced for you and will ship after the manufacturing period of six to twelve weeks. Any cancellations made more than 48 hours from the initial order date will be subject to a 50% restocking fee. Please contact us if you have any questions regarding this lead time.

• Aluminum replacement lips for multi-piece wheels are mirror polished, but may have minor surface imperfections upon delivery. We do our best to ensure their quality is excellent, but some very minor blemishes may occur during shipping. These minor imperfections are correctable with aluminum polish available from any automotive parts store and therefore we will not authorize returns or exchanges for these claims.

• M8x32, M7x32, M7x24 & M7x22 wheel assembly bolts are engineered to be used on stock 2-piece & 3-piece wheel diameter and width configurations. Using these bolts on any wheel configuration that has been modified outside of its original specification or vehicle application is subject to potential bolt failure. This is especially true for those customers with up-convert setups. ULTIMATELY YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY! WE DO NOT PROVIDE ANY WARRANTY OR GUARANTEE FITMENT/SAFETY/PRODUCT LONGEVITY WHEN THESE BOLTS ARE USED ON UP-CONVERT SETUPS, MODIFIED WHEEL CONFIGURATIONS, VEHICLE ADAPTATION, AGGRESSIVE FITMENTS, ETC!

SHIPPING POLICY

• Shipping costs are calculated based upon weight and volume. All prices are quoted through UPS, FedEx or USPS in real time, but we cannot guarantee all prices to be accurate at all times.

• All Canadian orders are shipped using USPS Priority services. USPS does not charge brokerage fees, but you will still be responsible for duties when your package is delivered.

• Expedited shipping options, which include Next Day Air, 2nd Day Air, 3 Day Select, are not guaranteed, and are quoted from time of shipment. We cannot guarantee your product will arrive in the advertised time frame from the time of your order. Most orders being shipped via UPS or FedEx are picked up same day as long as you r order is received by 3:00pm EST. USPS orders must be received by 10:00am EST to ship the same day. Any USPS order received after 10:00am EST or UPS/FedEx orders received after 3:00pm EST will be picked up the next business day. Special order items and products that require assembly take longer to ship. Please see product description on website for lead time estimates. Shipping delays that occurs after the product leaves our warehouse due to inclement weather, technical errors, acts of God, etc, are not eligible for any type of reimbursement.

• Most items sold are shipped directly from our warehouse in Cary, NC. However, some parts are considered special order and others are drop shipped from a separate facility if our local inventory is exhausted. This may increase transit time and the shipping method used to send these products may be different from what was selected during checkout. If multiple items are ordered and one or more is a special order item, your purchase may be split into two or more separate shipments.

• Hawaii, Alaska and Canada are not eligible for oversize shipping, or any special order items. We only sell oversize parts and special order items within the lower-48 States.

• "Free Shipping" is only available to customers in the lower 48 contiguous states and is only available on some items in orders over $99.99

• Any information errors (ie incorrect address) are the responsibility of the customer, and if the address needs to be corrected once the package has shipped, a correction fee of $12.50 will apply. This correction fee is non-negotiable.

• All packages returned to sender due an incorrect shipping address, or because it was refused by the recipient, will result in a partial refund, less the cost of shipping. These cancellations will be charged a 20% cancellation fee, equal to our restocking fee. Please be sure the shipping address provided is accurate to avoid these penalties.

• UPS and FedEx do not ship to PO BOX addresses. If you enter a PO BOX address and select UPS or FedEx an address correction fee of $12.50 will occur. This correction fee is non-negotiable. This also may result in your package being returned to us. We are not responsible for checking the shipping method chosen against the shipping address provided. Please select USPS shipping for PO BOX orders.

• If you do not receive your shipment and the tracking information shows it was delivered, you must contact us within fifteen business days of the advertised delivery date. At that time we will submit a lost package tracer with the shipping carrier you selected. We will not send replacement products until the shipping carrier completes their investigation. UPS typically requires approximately ten business days from the time the claim is started. FedEx typically requires up to twenty-five business days from the time the claim is started. USPS typically requires ten business days from the time the claim is started, but can take up to ninety. Please note that these are the policies of the carrier and not Black Forest Industries. Black Forest Industries does not guarantee that any claim will be credited by the carrier until the claim process is complete. Black Forest Industries will not provide refunds for lost packages under any circumstances.

CANCELLATION POLICY

• Any order cancellation requests will be charged a 20% cancellation fee, equal to our restocking fee. If an order is placed and we are contacted thereafter asking to have the order canceled, this 20% restocking fee will apply. This fee may be waived under certain circumstances. However, at no time will we waive this fee for special order items which includes all parts listed on our website with an advertised lead time.

FOR ALL RETURNS

• No returns will be accepted without obtaining an RMA number.

• Uninstalled merchandise in new, unused condition may be returned within 30 days of original purchase and will be charged a 20% restocking fee. Original product packaging must also be in new, re-sellable condition. USED PRODUCTS AND/OR PRODUCTS WITH DAMAGED PACKAGING ARE NOT ELIGIBLE FOR RETURN.

• You must notify us within 30 days of original purchase that you would like to make a return. After your RMA is created you have the remainder of your 30 days, or 7 business days to return your item - whichever is greater. Any returns received outside of this time frame will not be accepted and delivery will be denied.

• RETURNS ARE NOT ACCEPTED ON THE FOLLOWING PRODUCTS: all M8x32, M7x32, M7x24 and M7x22 assembly bolts, wheel spacers, wheel lug bolts, BBS logo caps, BBS hex nuts, multi-piece wheel lips, multi-piece wheel barrels, electronic items {ie PEMS, Pro.MAF, radios}, lighting components, bulbs removed from their original packaging, all body/exterior parts {ie bumper, grille, spoilers, etc}, clothing {ie t-shirts, hats}, all Clearance Products and all special order items, which include: Airlift suspension products, BBS wheels, Fifteen52 wheels, Rotiform wheels, Miro wheels, Victor Equipment wheels, Avant Garde wheels, Racingline wheels, Maxton Design, South Bend Clutch kits, Peloquin & Wavetrac limited slip differentials, Active Autowerke parts, AFE Power parts, Eurospec parts, Magnaflow exhaust kits, all Kinetic Motorsport turbo kits, Frankenturbo kits, C2 Motorsport turbo kits and all APR exhausts, turbo kits and supercharger kits.

• BUYER MUST PAY RETURN SHIPPING. Return shipping costs are always responsibility of the customer. Exceptions will only be made if you were sent the incorrect product, or your product arrived physically damaged due to courier negligence. Any and all other returns are not eligible for shipping reimbursement, including original shipping costs.

• BUYER RESPONSIBLE FOR ORIGINAL SHIPPING COST. Even if the original order was shipped via the "Free Shipping" option, the buyer is responsible for the cost of the original cost of shipping, any refund will have that amount deducted from the total refund.

• Defective merchandise can be repaired or exchanged for same item within 5 business days of delivery. Returns for refund of defective merchandise require manager approval and will only be approved under special circumstances.

• Please allow 2-3 business days from the time your return is received for your refund to be processed.

PREPARING YOUR RETURN

• No returns will be accepted without obtaining an RMA number. Please e-mail us at sales@blackforestindustries.com to obtain a RMA and begin the return process.

• Once your RMA # is received, it will be in this format: AAA12345678 and it must be written legibly on the invoice or packing slip within, as well as on the outside of the return packaging.
Incoming packages without an RMA written on the outside of the box will be refused.

• You are responsible for making sure your returned item(s) are packaged in the same fashion of which they were received. Any damages to the returning item(s) due to poor re-packaging will result a loss of refund. This is a non-negotiable policy. Please be sure to properly package your returns.

• We recommend reviewing these packaging guidelines from UPS to ensure your product is returned to us in satisfactory condition:

• All returns must be received within your 30 day return window or within 7 business days of receiving a RMA #, whichever is greater. Any returns received outside of this time frame will not be accepted and delivery will be denied.

DAMAGED/MISSING/INCORRECT ITEMS

• All damaged/missing/incorrect parts requests will only be shipped to and from the original shipping address. If you had these parts sent to an alternate address, you will need to return those parts to that address in order for us to complete your exchange. If you live in Canada and have your parts shipped to the US, you will need to return them to the ship-to address in the US in order for us to honor your claim. *Please double check package contents before accepting them!*

• If you receive a damaged item, you must notify us within 5 business days from delivery to make a claim. You must keep all packaging and broken items in order for us to honor any claim requests. Failure to contact within 5 business days of delivery forfeits your opportunity to make a damage claim.

• If you are missing any items from your order, you must notify us within 5 business days from delivery to make a claim. Failure to contact within 5 business days of delivery forfeits your opportunity to make a missing items claim.

• If you were sent the incorrect item, you must notify us within 30 days from delivery to make a exchange. Failure to contact us within 30 days of delivery forfeits your opportunity to make an exchange.

• All replacement parts for orders containing damaged/missing/incorrect parts will be shipped using the same shipping method that was originally paid for. We are unable to expedite replacement parts for any of the above listed conditions.

PEM RETURN SERVICE

• Black Forest Industries offers a return service and warranty replacement for ALL PEM modules sold through our webstore. Please email all inquires to support@blackforestindustries.com and we can help you if you are having difficulty with your PEM module.

• Due to recent changes in warranty policy from our encryption module manufacturer we have been forced to change our warranty policy to reflect their change. All warranty defects related to the encryption module integrity are now limited to 6 months after purchase. The PLCC chip and its associated software write (burn) are still covered under a limited lifetime warranty. Please contact us for further details.

WARRANTY

• Black Forest Industries warranties their products against defects in material and workmanship for one (1) year from the original date of purchase, unless otherwise specified. Warranty applies to original purchaser and is not transferable. This applies to products manufactured by Black Forest Industries – and not those sold/distributed by Black Forest Industries. Other manufacturer’s products default to their expressed warranty.

• All warranty claims on lighting products - including headlights, taillights, bumper and side markers - are handled directly by our supplier. These products will either be repaired or replaced by our supplier. Return shipping costs to and from our supplier are responsibility of, you, the customer.

• Exceptions to the warranty include, but are not limited to, wear and tear items such as brake rotors, brake pads, flywheels and clutches and clearance (whose deposit and sale are FINAL).

• Warranty will become void if:
▫ the product has been used in competition / racing
▫ the product has been abused, misused, or improperly maintained
▫ repairs have been made or attempted by anyone other than an authorized Black Forest Industries dealer, unless cleared before hand by Black Forest Industries LLC
▫ repairs are required because of normal wear and tear
▫ alterations have been attempted or made to the product
▫ the product is classified as a consumable
▫ the product has been involved an accident

• This warranty is limited to repairs and/or replacement of the product or part found to be defective without charge. Black Forest Industries reserves the right to refund the complete purchase price for the defective item and will not be held liable for losses or damages arising from the defect.

• If a part or a component from an Black Forest Industries product, system or kit is found to be defective, this warranty shall apply only to the defective part or component and shall not require Black Forest Industries to repair, replace or refund the complete Black Forest Industries product, system or kit.

• Under the stipulations of this warranty, Black Forest Industries will in no way be liable for exceeding the original purchase price of the defective product. This warranty does not include the cost of removal or reinstallation of the product. No person or representative is authorized to extend any warranty and/or liability (other than that which has been expressed herein) in connection with the sale of any Black Forest Industries product. Black Forest Industries disclaims any and all liability for any implied warranties, including the implied warranties of merchantability and fitness for a specific purpose. Under no circumstances shall Black Forest Industries be liable for any incidental, indirect, specific or consequential damages arising from purchaser's use of the product.

SUBMISSIONS

• Any communication or material submitted to Black Forest Industries will be considered non-confidential unless stated otherwise. CONTESTS

• At certain times, Black Forest Industries may conduct contests, which will be subject to particular Official Contest Rules. Any contest conducted by Black Forest Industries is open to contestants 18 years of age or older residing in North America, excluding employees of Black Forest Industries and their immediate family, the latter consisting of parents, siblings, children or any person residing in the same household as the employee.) • Any prize awarded in connection with a contest conducted by Black Forest Industries is non-transferable. You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the Program or from you providing us with a phone number that is not your own. If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the Opt-Out process set forth above prior to ending your use of the mobile telephone number. You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Program, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

You may not use or engage with the Platform if you are under thirteen (13) years of age. If you use or engage with the Platform and are between the ages of thirteen (13) and eighteen (18) years of age, you must have your parent’s or legal guardian’s permission to do so.
